Common questions
Who regulates vaping in Australia?
Vaping products are regulated nationally by the Therapeutic Goods Administration (TGA). States and territories add their own laws, particularly on where vaping is allowed. Both have changed since 2024, so check the official sources linked on this page for the current position. General information, not legal advice.
How old do you have to be?
Selling vaping products to anyone under 18 is illegal everywhere in Australia. We only sell to adults 18 and over.
Is a prescription needed for nicotine vapes?
Since 2024, supply of vaping products has moved towards pharmacies. Whether a prescription is needed depends on the product and your circumstances. The TGA and a pharmacist can tell you what applies to you.
Where am I allowed to vape?
It depends on your state or territory. Smoke-free area laws usually cover vaping too, and councils can add local rules. Your state or territory health authority, linked below, sets out the rules where you live.
What is the position on nicotine pouches?
Regulation of nicotine pouches has also been changing. Check the TGA and your state or territory health authority before buying.
Where is the official information?
The TGA (tga.gov.au), the Australian Government Department of Health, and your state or territory health department publish the authoritative rules.
